Terms and conditions
Agreement between you and Khimji Ramdas LLC
- The Nikon Premium Member loyalty card is free of charge and is immediately available upon the purchase of any Nikon Full Frame Camera or the Nikon D500 or any NIKKOR lens worth OR.500 or more in a single purchase.
- The customer is given a NPM card and would have to register on the NPM website npm-mea.com to join the NPM programme.
- The registration can be done at the time of purchase at the Khimji Ramdas store with the help of the store staff.
- The registration process must be completed within 90days from date of the purchase of the product failing which Khimji Ramdas LLC reserves the right to deny the subscriber access to the Nikon Premium Member program and all the benefits it entails.
- The NPM loyalty card cannot be transferred or used by anyone other than its subscriber/member himself, for any reason.
- Upon registration as a Nikon Premium Member for the first time the member is entitled for the following for benefits:
- Travel: Discount of USD 500 per month for a maximum of 12 months on photo tours organized by Nikon exclusively for its Nikon Premium Members but subject to the following conditions:
- Seats are limited to only 15 per month for the entire region where the program is available and will be booked on a first come, first served basis.
- All travel bookings will be handled by the travel agency/ partner appointed by Nikon – Musafir LLC.
- Once the booking form on the NPM website is filled out by a consenting member, the form will be forwarded to the appointed travel partner and a designated travel representative will get in touch with the member to plan the booking.
- The member is allowed a certain degree of flexibility with the choice of flights (direct/connecting) as long as it accommodates and adheres to the itinerary of the trip.
- Khimji Ramdas LLC and the appointed travel agent reserve the right to refuse a flight route if it causes inconvenience to the planned itinerary.
- Rooms will be booked on a single occupancy basis for each member and the hotels will be non-negotiable and will be decided on by the appointed travel agent.
- Should a traveler/member wish to share a room with another traveler/member he may let the concerned travel agent know at the time of booking and the travel agent will then help look for other travelers who are willing to split the room costs (stay on a double occupancy basis) and will make the required arrangements.
- The itinerary of the trip is not flexible and all members travelling are expected to adhere to the itinerary and cooperate with the tour facilitator and photography instructor.
- Once the flight routes, hotel stay and itinerary are confirmed by the member, the final price of the package will be provided by the appointed travel agent and on that price the member can then avail the USD 500 discount.
- The trip once booked and paid for, is nonrefundable under any circumstances.
- Khimji Ramdas LLC, the travel agent or Nikon Middle East FZE do not shoulder any responsibility in case of any accidents, illness, diseases or fatality that any member may encounter on the trip.
- All members travelling are expected and required to issue their own travel insurance. Khimji Ramdas LLC, the travel agent or Nikon Middle East FZE do not shoulder any responsibility in case of baggage loss, damage or theft during the entire trip. The member is required to take full responsibility for his belongings at all times and is expected to book an insurance that covers all liabilities.
- Learn: One exclusive Photography Workshop for Nikon premium Members to be availed via online booking on the www.npm-mea.com website within the first 12 months of registration.
- Borrow: A free NIKKOR lens loan voucher to be availed via online booking on the www.npm-mea.com website within the first 12 months of registration subject to the following conditions:
- The NPM member (Customer) must present the original copy of their valid current ID card and deposit an amount of OMR.250 in the form of a credit card authorization or cash to be returned upon completion of the loan.
- Inspection: The Customer will not leave Khimji Ramdas store (Aalami) with the Inventory until a full “Inspection of Inventory” form is completed and initialed by Customer and a Khimji Ramdas representative. Upon execution of said form Customer acknowledges that the equipment is in good condition and working order. All third party operators and handlers of equipment will be bound to Terms and Conditions.
- Uses and Care of Inventory: Customer agrees to use and maintain the loaned equipment at their own expense, according to the Manufacturer’s Instructions, and per Khimji Ramdas’s instructions, if any. Customer may not make any modifications to the equipment without Khimji Ramdas’s prior written consent; such consent may be withheld in Khimji Ramdas’s sole discretion. Customer agrees that they will not misuse or abuse the equipment or use it in any unlawful way. Customer must obtain prior written consent from Khimji Ramdas to remove the equipment from the state or country; such consent may be withheld in Khimji Ramdas’s sole discretion. Khimji Ramdas’s logos and identification numbers must never be concealed or removed.
- Insurance Options. Customer may obtain Third Party Insurance with a Certificate of Liability for full replacement of all inventory loaned from Khimji Ramdas as set out in the Equipment Loan Agreement. If a Customer selects the Third Party Insurance option, it must be enforced and maintained at the sole cost of the Customer prior to equipment leaving Khimji Ramdas’s premise and remain in force until the equipment is returned to Khimji Ramdas. Insurance must be special form providing covered for the full replacement value of the entire Loan. Coverage must be on premise, in transit, unnamed locations and worldwide. It must include a “Locked Car” clause, covering the inventory in a car at all times. Unattended Vehicle Theft Exclusion won’t be accepted. The certificate of insurance must list Khimji Ramdas as an additional insured party and a loss payee on the commercial general liability policy. Company shall be designated as follows: Khimji Ramdas.
- No Warranties: Customer is solely responsible in completing a detailed Inventory Checklist provided by Nikon Middle East FZE. Equipment is loaned AS-IS. All media management is in the sole responsibility of the Customer and Nikon Middle East FZE is not responsible for any data loss. Nikon Middle East FZE makes no warranties, express, implied, or otherwise, as to the performance of equipment, services, supplies, or film. Furthermore, Nikon Middle East FZE makes no warranties, express, implied, or otherwise, of merchantability or fitness for a particular purpose.
- Pick Up and Return of Equipment: Acceptance by Khimji Ramdas of the returned Loan equipment does not waive any claims Khimji Ramdas may have against Customer, including, but not limited to, claims for latent, patent, or hidden damage. Equipment must be picked up and returned at the time set forth by the Agreement. If Customer needs to pick up or return any equipment at a different time than the time set forth by the Equipment Loan Agreement, they must contact Khimji Ramdas to make arrangements. 1 day past return time set forth by the Equipment Loan Agreement: OMR.60 of the order total will be charged as Late Fee. 2 days past return time set forth by the Equipment Loan Agreement: OMR.110 of the order total will be charged as Late Fee. 3 days past return time set forth by the Equipment Loan Agreement: OMR.160 of the order total will be charged as Late Fee.
- Damaged or Lost Equipment: Customer is solely responsible and liable for any and all loss, including theft, and/or damage to the equipment during the period covered by the Loan Agreement. In the event of any loss or damage to the equipment, Customer agrees to pay the Loan rate during the period of time KHIMJI RAMDAS is deprived of the equipment and until such time as it is repaired and/or replaced. Khimji Ramdas reserves up to 48 hours from when the item is returned to alert the Customer of any issues. In the event of any equipment damage, Khimji Ramdas must handle all and any repairs.
- Equipment Valuation: Customer agrees that the value of the equipment, in the event of damage or loss requiring replacement of said equipment, is determined by the cost of a similar replacement device, as determined by Khimji Ramdas.
- Khimji Ramdas can nullify this Agreement and repossess the Equipment with no notice to Company or any involved parties. Khimji Ramdas reserves the right to inspect the Equipment at any time during the Loan Period. The Customer agrees to allow any representative from Khimji Ramdas on-camerasite access to Inventory at any time.
- Indemnification: Customer agrees to assume full responsibility and liability for the safekeeping and return of all loaned equipment accepted by Customer. Customer agrees to indemnify and hold harmless Khimji Ramdas and any other persons to which Khimji Ramdas may be responsible to indemnify and hold harmless, from any and all liability, claims, damages, costs, including legal fees, and expenses arising from Customer’s use, misuse and/or possession of the loaned equipment.
- Authority Warranty: Customer hereby warrants that any person which it directs or allows to receive equipment from Khimji Ramdas, or who shall sign for acceptance of equipment, is authorized by Customer to do so. This authorized person is bound to the same terms of this Agreement. Customer herein waives any obligation on the part of Khimji Ramdas to confirm said person’s authority to act on behalf of Customer.
- Construction and Edits: In the event any parts of this Agreement are found to be void, the remaining provisions of this shall be binding. This document shall remain unedited unless a written Agreement is made between Customer and KHIMJI RAMDAS.
- Titles and Limitation of Liability: The sole title of ownership and all rights to ownership of the Equipment shall, at all times, remain with Khimji Ramdas. In no event shall Khimji Ramdas be liable to Customer or any third party for any loss, without limitation. Customer hereby agrees to assume full responsibility and liability for any such Claims and for the safekeeping and return of all Equipment loaned by Customer.
- Non-Exclusivity/Non-Assignment: This is a non-exclusive. Customer shall not sell, sublease, or loan the Equipment or assign any of its rights or obligations under this Agreement to any other person or entity.
- Service: Free Camera or Lens cleaning to be availed via online booking on the www.npm-mea.com website within the first 12 months of registration.
- On the subsequent purchase of any Nikon Premium Product, the customer is required to update his online account and add the newly purchased product details corresponding with the NPM card number, after which the member can avail the following benefits for a period of 12 months after registration of the product.
